WHAT THIS PAGE COVERS

These Terms and Conditions cover your use of this website, the free content on it, and any tutorials, lessons or other learning materials we make available to members.

They do not cover purchases. If you buy a Joyous Mail membership, that purchase — including pricing, automatic renewal, shipping and cancellation — is governed by our Terms of Service at checkout. If anything on this page appears to conflict with those Terms of Service on a matter relating to a purchase, the Terms of Service govern.

NOTICE: These Terms and Conditions are legally binding. Please read them before using this website. By using this website on any computer, phone, tablet or other device, you agree to these Terms and to the collection, use and disclosure of your information as described in our Privacy Policy at joyousbalance.com/privacy-policy. If you don't agree, please don't use the site.

WHO WE ARE

Joyous Balance Designs is a sole proprietorship owned and operated by Joy Ferguson, based in California, United States. Where these Terms say "we", "us" or "our", they mean Joyous Balance Designs. Where they say "you", they mean you — the person using this website.

USING THIS WEBSITE

You must be at least 18 years old to use this website or to purchase anything from us.

Use of this website is at your own risk. We host on a reputable platform and make reasonable efforts to keep the site running and secure, but we make no promises about the safety of your individual use of it. These Terms may change at any time; the date at the top tells you when they last did. We reserve the right to modify, suspend, or discontinue any part of the website or its content at any time without notice.

When using this website, you must not:

Do anything that damages the site or affects its performance, availability or accessibility.
Send or try to send any virus, malware or malicious code.
Use the site in any way that is unlawful, illegal or fraudulent.
Use any content from this site in connection with artificial intelligence or related technologies — including machine learning systems, algorithms, models, scraping tools, or any automated process capable of copying, modifying or manipulating the content — unless we have given you written permission first.

That last one matters to us. The lettering and artwork on this site is drawn by hand, and we'd rather it not be fed into a machine.

OUR WORK, AND WHAT YOU MAY DO WITH IT

All calligraphy, lettering, artwork, images, text, designs, graphics, trademarks and service marks on this website are owned by Joyous Balance Designs, or by the party properly credited. Every piece of lettering here took time and a steady hand to make.

What you may do. You're welcome to share our work in the ordinary, human way: post a photo of your Joyous Mail envelope, screenshot something that made you smile, repost a piece of our lettering to social media — as long as it's personal, non-commercial, and you credit Joyous Balance Designs and don't crop out our mark. We'd love that. Tag us.

What you may not do. You may not reproduce, redistribute, sell, license, or create derivative works from our designs or lettering; use them in any commercial context; republish substantial portions of this site elsewhere; remove or obscure our name or watermark; or use our artwork as reference or training material for any automated or AI system.

We're happy to be generous about sharing and firm about copying. If you're not sure which side of the line something falls on, email and ask — the answer is usually yes.

Unauthorized use of our intellectual property may violate federal and state law, and we reserve the right to enforce our rights, including by seeking damages or an injunction.

MEMBER CONTENT AND TUTORIALS

Each month's Joyous Mail includes access to a tutorial or lesson, unlocked by a code in your envelope. We may also make other learning materials available to members from time to time. Here's how that works.

Access is a membership benefit. They are included with your membership and are not sold as a separate product. If your membership ends or lapses, your access to member content ends with it.

What you learn is yours. Anything you make using the techniques we teach belongs to you, including work you sell. We're teaching you a craft, not licensing it to you. Go make beautiful things and charge for them.

What you may not do with the tutorial itself. Don't share your login, don't record, download, copy, re-upload or redistribute the materials, don't teach our tutorial as your own, and don't resell access. One membership, one person.

No promises about how it goes. Our tutorials are provided for educational purposes. Calligraphy is a physical skill and results depend on your practice, your tools and your hands. We can't and don't guarantee any particular level of skill, speed of progress, or outcome — including any commercial or income outcome — from anything we teach.

SECURITY

Keeping your username and password safe is your responsibility. We do not store complete card numbers or payment details; payments are handled by third-party processors. By using those processors you agree to be bound by their terms, and you accept the risk associated with their handling of your payment details.

YOUR COMMUNICATIONS TO US

Communications you send us are generally not treated as confidential unless required by law. This includes anything sent through the contact form, blog comments, newsletter replies, email, phone or post, and we may need to share it with third parties in the ordinary course of running the business — with our email platform, for example. How we store and use it is set out in our Privacy Policy.

We may republish a submission in whole or in part where reasonably necessary to run our business — a kind note quoted on a sales page, say. If you'd rather we didn't quote you, just say so and we won't. We don't pay royalties for unsolicited content such as blog comments or emails.

Please don't send us anything illegal, libelous, maliciously false, obscene, abusive, or otherwise harmful or inappropriate.

DISCLAIMERS

The content on this website is provided for general information and educational purposes. Physical products purchased from us are covered by the Terms of Service at checkout, not by this section.

While we try to keep this site accurate and current, we can't guarantee that everything on it is complete, correct or up to date. Any reliance you place on information here is at your own risk. If you spot an error, please tell us at [email protected] and we'll fix it.

TERMINATION

If we believe you have violated these Terms, we may end your access to this website and to any member content, at our discretion and without notice, and where necessary block your IP address.

If you hold an active Joyous Mail membership, ending your website access does not on its own cancel your membership or affect anything you have already paid for. Membership cancellation and refunds are covered by the Terms of Service at checkout.

LAW AND JURISDICTION

These Terms and our Privacy Policy are governed by and construed in accordance with the laws of the State of California and the United States. Any dispute arising out of or related to them is subject to adjudication in the state and federal courts located in California, and you consent to jurisdiction and venue there.

If you are using this site from outside the United States, you do so on your own initiative and are responsible for complying with your own local laws. Nothing here takes away any consumer rights you have under the mandatory law of your own country that cannot be waived by agreement.

ELECTRONIC COMMUNICATIONS

As permitted by applicable law, you consent to receive electronic communications from us — by email or text — if you contact us that way or otherwise give us your email address or phone number. You agree that any agreements and communications we provide to you electronically satisfy any legal requirement that they be in writing.

ENTIRE AGREEMENT

SEVERABILITY

If any part of these Terms or our Privacy Policy is found unlawful or unenforceable, the rest stays in full force and effect.

If you would like to opt out of any activity that may be considered a "sale", a "share", or "targeted advertising", please email us at [email protected]. "Sharing" refers specifically to sharing for cross-context behavioral advertising — targeting advertising to you based on your online activity across different websites.

If required by an applicable data privacy regulation such as the California Privacy Rights Act, we will wait at least 12 months before asking you to opt back in to the sale or sharing of your personal information.
